These General Terms and Conditions (hereinafter: “ETCM”) govern the use of the Eco Tours Chiang Mai online mediation platform, which can be accessed, among others, at the url www.ecotourschiangmai.com (hereinafter collectively “ETCM platform”).
1. About us
We, Eco Tours Chiang Mai registered address in Chiang Mai under the Thai Eco Solutions brand.
We operate the ETCM Platform as an intermediary platform on which tours and Activities (collectively “Activity” or “Activities”) are offered online by a variety of local Suppliers around Chiang Mai and the surrounding provinces. We act as a commercial agent for the Suppliers. The descriptions and illustrations of these Activities originate from the respective Suppliers. We therefore have no direct influence on the scope of such content.
What we do
2.1 You can view Activities anonymously on the ETCM platform. The Activities include, for example, guided tours, mountain biking, trekking, cooking classes and more. The contract for the provision of the activity is concluded exclusively and directly between you and the Supplier (“Service Agreement”). On the side of the Suppliers, the contracts are concluded by us on behalf and for the account of the Suppliers. We act as a commercial agent for the Suppliers and are commissioned and authorized by the Suppliers to conclude transactions between the Suppliers and the Users, e.g. you, and for the account of the Suppliers and to collect payments from the Users. We do not offer any Activities ourselves and therefore do not become your contractual partner of the Service Agreements. We do not act as the organizer, the landlord, seller or other contractual partner in relation to the Service Agreement with you.
2.2 In the interest of a fast and smooth process – you may ask questions about your booking to via email, whatsapp or Facebook. We will endeavor to respond within 12 hours. The communication between you and the Supplier can be done directly. In case of emergency, the contact details of the respective Supplier can be found on your email voucher.
Making a Booking / Payment
All reservations must be paid in advance. Bookings are made and paid for through our website via our booking system (Bokun), which accepts major credit and debit cards and other online payment methods.
Once a booking is completed, you will receive an automatic confirmation email. In some cases, we may contact you to request additional information required for insurance or safety purposes. A booking is only considered fully confirmed once payment has been received and any required information has been provided. Until then, we reserve the right to release the space on a first-come, first-served basis.
Alternative payment methods such as Wise may be accepted by prior arrangement. Any transfer fees or currency conversion costs are the responsibility of the customer.
No person may join a tour without full payment and a confirmed booking in our system.
3. Conclusion of contract with the Supplier – Service Agreement
By booking an activity on our website, you enter into a service agreement with Eco Tours Chiang Mai. A booking becomes binding once you complete the online checkout and receive a booking confirmation.
Some tours may require additional participant information for safety or insurance purposes. In such cases, the booking is only fully confirmed once all required information has been provided.
Please check your confirmation email carefully and notify us immediately of any errors.
4. Customer service / Best Price Guarantee

5.2 If you find the activity booked via the ETCM platform (i) with the same conditions (date, city, number of persons) and (ii) with the same services (iii) at a lower price on the Internet (iv) bookable with the same Supplier and prove this to us, we will pay you the difference between the lower price booked via Eco Tours Chiang Mai and the lower price found and available by you on the Internet.
5.3 To make use of this best price guarantee, you must send us the link (and/or a screenshot of the alternative offer) upon request. We will then check this and should the price actually be lower, pay the difference, whereby this payment can also be made by means of a voucher.
5.4 All special offers and discount promotions are marked as such.
5. Implementation of the Activity (Service Agreement)
7.1 You must arrive on time at the meeting point indicated by the Supplier. Please also take note of the Supplier’s terms and conditions. If you are traveling to the activity from abroad, you are responsible for the necessary travel documents (passport, visa, etc.) and compliance with health requirements, etc.
7.2 The booking price of the services does not include insurance. You are responsible for sufficient insurance coverage. The insurance requirement depends on the booked activity.
7.3 For time and deadline calculations, the time zone of the Supplier shall be decisive.
6. Cancellations and Refunds
a) Standard Day Tours
Cancellation more than 24 hours before the scheduled departure time:
Full refund.
Cancellation within 24 hours of the scheduled departure time:
No refund (100% of the tour price is forfeited).
b) Car / Van and Driver Service
All vehicle and driver bookings require full payment at the time of reservation. By confirming your booking, you agree to the following cancellation terms:
Cancellation more than 24 hours before the scheduled pickup time:
A 50% refund will be issued. The remaining 50% is retained to cover driver allocation, scheduling, and operational costs.
Cancellation within 24 hours of the scheduled pickup time:
No refund will be issued, as the vehicle and driver are reserved exclusively for your booking.
c) Bamboo Rafting and Overnight Tours
Due to advance payments made to third-party suppliers, special conditions apply:
Cancellation more than 24 hours before the scheduled departure time:
Full refund minus the cost of the bamboo raft rental and accommodation (this portion is prepaid and non-refundable).
Cancellation within 24 hours of the scheduled departure time:
No refund (100% of the tour price is forfeited).
7. Supplier Rights and Force Majeure
7.1 We reserve the right to cancel or modify a tour if weather conditions, government regulations, natural disasters, strikes, safety concerns, or other circumstances beyond our control (force majeure) make it impossible or unsafe to operate. In such cases, a full refund will be issued. No additional compensation can be claimed.
7.2 We reserve the right to refuse or remove any participant from a tour if they do not meet the participation requirements, are unfit to take part, behave in a way that endangers themselves or others, or seriously disrupt the tour. In such cases, no refund will be provided.
7.3 Minor changes to the itinerary, schedule, or meeting point may be made when necessary due to operational or safety reasons. If the meeting point is changed, it will be within reasonable distance of the original location and communicated in advance by email or through our booking system. Such changes do not entitle the customer to a refund.
8. Data protection
8.1 We always process your personal data in accordance with the legal regulations.
9. Indemnification
You agree to indemnify and hold Eco Tours Chiang Mai harmless from any claims, losses, damages, costs, or legal expenses arising from:

Your false information, actions, or omissions in connection with your booking or participation in our services.

Your breach of these Terms and Conditions.

Claims made by third parties resulting from your misuse of our website or services.
This applies only where you are legally responsible through negligence or intentional misconduct.
10. Liability
10.1 Our liability is limited to direct and foreseeable damages arising from a material breach of contract. We are not liable for indirect or consequential losses.
10.2 Nothing in these Terms limits liability for gross negligence, intentional misconduct, personal injury, death, fraud, or any liability that cannot be excluded under applicable law.
10.3 We are not liable for delays, changes, or failures caused by events beyond our reasonable control, including but not limited to natural disasters, extreme weather, government actions, strikes, technical failures, or other force majeure events.
11. Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except for statutory claims for damages.
12. Final provisions
12.1 We may update these Terms and Conditions when required by law, regulatory changes, or operational reasons. Updated terms will be published on our website and will apply to all future bookings.
12.2 All communications between Eco Tours Chiang Mai and the customer must be made in writing or electronic form (including email).
